ACCEPTANCE OF TERMS

By downloading, installing, or using any Drage Group ("Apps"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not download, install, or use the App.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

No Warranty for Maintenance Records or Data

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:

  1. The accuracy, reliability, or completeness of any maintenance records, schedules, or data stored within the App

  1. The suitability of the App for tracking maintenance of any specific machinery or equipment

  1. The App's ability to prevent equipment failures, malfunctions, or accidents

  1. The continuous, error-free, secure, or virus-free operation of the App

Limitation of Liability for Equipment and Inventory Management

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO:

  1. Equipment failures, malfunctions, or accidents that occur despite maintenance tracking through the App

  1. Loss of data, maintenance records, or inventory information stored within the App

  1. Incorrect maintenance records or schedules generated by or entered into the App

  1. Decisions made based on information provided by the App

  1. Any damage to machinery, equipment, or inventory that may result from following or not following maintenance schedules or recommendations provided through the App

User Responsibility

You acknowledge and agree that:

  1. The App is a tool to assist with maintenance management and is not a substitute for professional judgment

  1. You are solely responsible for the proper maintenance of your equipment and machinery

  1. You are responsible for the accuracy of all data entered into the App

  1. You should maintain independent backup records of all critical maintenance information

  1. You should regularly verify the accuracy of information stored within the App

Data Loss

While we implement reasonable measures to protect your data, we cannot guarantee against data loss. You acknowledge that:

  1. Technical failures, app updates, device changes, or other circumstances may result in data loss

  1. You are responsible for maintaining appropriate backups of your important data

  1. We shall not be liable for any loss of data, regardless of the cause

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless our company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  1. Your use of the App

  1. Any maintenance activities performed or not performed based on information from the App

  1. Any equipment failures or accidents related to your use of the App

  1. Any violation of these Terms

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
