PRIVACY POLICY

Drage Apps ("we," "us," or "our") operates the Shade mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our App.

1. Information We Collect

Personal Health Information:

  • Skin type and sensitivity data

  • Gender information (optional)

  • Sun exposure tracking data

  • Skin health logs and photographs

  • User-created notes and observations

Location Data:

  • Precise location (GPS coordinates) when you use the App

  • Location data is used only to provide real-time UV index information

  • Location is not continuously tracked or stored permanently

  • You can disable location access in your device settings at any time

Usage Data:

  • App interaction data

  • Feature usage statistics

  • Notification preferences

  • Technical diagnostics for app performance

Photos and Camera:

  • Photos you take within the App for skin tracking

  • Camera access is only used when you actively choose to take a photo

  • Photos are stored in your private iCloud account, not on our servers

2. How We Use Your Information

We use your information to:

  • Provide personalized UV protection recommendations based on your skin type

  • Calculate safe sun exposure times

  • Track changes in your skin health over time

  • Send you timely notifications about UV levels and sunscreen reapplication

  • Sync your data across your devices via iCloud (if enabled)

  • Improve app functionality and user experience

  • Provide customer support

We do NOT:

  • Sell your personal health data to third parties

  • Share your photos or skin data with advertisers

  • Use your data for marketing purposes without consent

  • Access your data on our servers (data stays on your device and iCloud)

3. Data Storage and Security

Local Storage:

  • Your data is primarily stored locally on your device using encrypted storage

  • App data is secured using iOS device encryption

iCloud Storage:

  • If you're signed into iCloud, your data is backed up to your private iCloud account

  • iCloud data is encrypted both in transit and at rest

  • We do not have access to your iCloud data

  • Only you can access your data through your Apple ID

Third-Party Services:

  • OpenWeatherMap: We use this service to fetch UV index data based on your location. They may collect anonymous location data for their service.

  • RevenueCat: We use this service for subscription management. They collect purchase information as required for transaction processing.

  • Apple CloudKit: Used for secure data synchronization across your devices

We implement industry-standard security measures including:

  • End-to-end encryption for data transmission

  • Secure authentication for cloud services

  • Regular security audits and updates

4. Data Sharing and Disclosure

We do not sell, rent, or share your personal health information with third parties for their marketing purposes.

We may disclose your information only in the following circumstances:

  • With your explicit consent

  • To comply with legal obligations (court orders, subpoenas, or legal processes)

  • To protect our rights, property, or safety, or that of our users

  • In connection with a business transfer (merger, acquisition, or sale of assets), where the acquiring party agrees to honor this privacy policy

Your photos and health data remain private and are never shared without your explicit permission.

5. Your Privacy Rights

You have the right to:

Access: View all your personal data stored in the App through Settings > Data Storage

Export: Download a complete copy of your data including photos and logs (Settings > Data Storage > Export)

Delete: Permanently delete all your data from the device and iCloud (Settings > Data Storage > Delete All Data)

Correct: Update or correct your profile information at any time (Settings > Edit Profile)

Opt-Out: Disable notifications, location services, or iCloud sync in Settings

Portability: Export your data in standard formats (JSON, HTML) for use with other services

For residents of California (CCPA), the EU/UK (GDPR), and other jurisdictions with privacy laws, you have additional rights. Contact us to exercise these rights.

6. Children's Privacy

Our App is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately, and we will delete such information.

7. International Data Transfers

Your data is stored on your device and in your personal iCloud account. iCloud storage location depends on your Apple ID country/region. Apple handles data transfers in compliance with applicable laws including GDPR.

If you're located outside the United States, please note that Apple and our third-party service providers may process data in the United States or other countries.

8. Data Retention

We retain your data for as long as:

  • You have the App installed on your device

  • Your iCloud backup exists

  • You maintain an active account

You can delete all your data at any time through Settings > Data Storage > Delete All Data. Upon deletion, your data is permanently removed from your device and iCloud within 30 days.

Some anonymous usage analytics may be retained longer for service improvement purposes.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will:

  • Update the "Effective Date" at the top of this policy

  • Notify you through the App or by email for significant changes

  • Post the updated policy in the App

Your continued use of the App after changes constitutes acceptance of the updated Privacy Policy.

These Terms of Service ("Terms") govern your use of the Shade mobile application ("App") operated by Drage Apps ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Shade, you agree to:

  • These Terms of Service

  • Our Privacy Policy (incorporated by reference)

  • Apple's App Store Terms and Conditions

If you do not agree to these terms, you must not use the App and should delete it from your device immediately.

You must be at least 13 years of age to use this App. If you are under 18, you must have parental or guardian consent.

2. Description of Service

Shade provides the following features and services:

  • Real-time UV index monitoring based on your location

  • Personalized sun protection recommendations based on skin type

  • Smart Protection Timer for sun exposure tracking

  • Skin health tracking with photo documentation

  • Burn time calculations and safety notifications

  • Data synchronization across your Apple devices via iCloud

The App is intended for:

  • General wellness and health education purposes

  • Personal sun protection tracking

  • Informational use only

The App is NOT intended for:

  • Medical diagnosis or treatment

  • Professional medical advice

  • Emergency medical situations

  • Replacement of professional dermatological care

3. Medical Disclaimer - IMPORTANT

CRITICAL DISCLAIMER: Shade is NOT a medical device and should NEVER replace professional medical advice, diagnosis, or treatment.

You acknowledge and agree that:

  • The App provides general information only and is not medical advice

  • UV index data and burn time calculations are estimates and may not be accurate for your individual circumstances

  • Individual skin sensitivity varies significantly and the App cannot account for all factors

  • The App does not diagnose, treat, or prevent any medical conditions

  • Changes in moles, skin lesions, or concerning skin conditions require immediate professional medical evaluation

  • Sunburns and skin damage require medical attention, not just app tracking

  • Always consult qualified healthcare professionals (dermatologists, doctors) for medical concerns

  • Never ignore professional medical advice based on App recommendations

  • Emergency skin conditions (severe burns, allergic reactions, suspicious moles) require immediate medical care

Use of the App is at your own risk. We are not responsible for any health outcomes related to sun exposure.

4. User Responsibilities

As a user of Shade, you agree to:

  • Provide accurate information about your skin type and sensitivity

  • Use sun protection (sunscreen, clothing, shade) in addition to the App

  • Not rely solely on the App for sun protection decisions

  • Use the App responsibly and in accordance with these Terms

  • Comply with all applicable laws and regulations

  • Respect intellectual property rights

  • Not attempt to reverse engineer, decompile, or modify the App

  • Not use the App for any unlawful or prohibited purposes

  • Report any bugs, security issues, or concerns responsibly

  • Seek professional medical advice for any skin health concerns

You are responsible for:

  • Maintaining the security of your Apple ID and device

  • All activity that occurs under your account

  • Backing up your data (though iCloud backup is automatic)

  • Understanding and accepting the limitations of UV forecasting and burn time calculations

5. Subscription Terms (Shade+ Premium)

Shade+ Premium Subscription:

Billing:

  • Subscriptions are billed through your Apple ID account

  • Payment is charged to your Apple ID at confirmation of purchase

  • Available plans: Monthly and Annual subscriptions

  • Prices are displayed in the App and may vary by region

Auto-Renewal:

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage or cancel subscriptions in your device Settings > Apple ID > Subscriptions

Free Trial (if applicable):

  • Free trials convert to paid subscriptions unless cancelled before trial ends

  • You can cancel during the trial period without charge

Cancellation:

  • You can cancel anytime through your Apple ID subscription settings

  • Cancellation takes effect at the end of the current billing period

  • No refunds for partial subscription periods

Refunds:

  • Refund policies are governed by Apple's App Store terms

  • To request a refund, contact Apple Support directly

  • Drage Apps does not process refunds; all purchases are through Apple

Premium Features:

  • Burn time calculations and smart recommendations

  • Smart Protection Timer

  • Unlimited skin health timeline entries

  • Advanced analytics and insights

  • iCloud sync across devices

  • Priority customer support

Premium features require an active subscription and are disabled if subscription expires.

6. Intellectual Property Rights

Ownership:

  • Shade and all related content, features, and functionality are owned by Drage Apps

  • The App, including its design, code, graphics, and user interface, is protected by copyright, trademark, and other intellectual property laws

Your Content:

  • You retain all rights to photos and data you create within the App

  • By using the App, you grant us a limited license to store and process your data solely to provide App services

  • We do not claim ownership of your photos, notes, or health data

Restrictions:

You may not:

  • Copy, modify, or create derivative works of the App

  • Reverse engineer or decompile the App

  • Remove any copyright or proprietary notices

  • Use the App's name, logo, or branding without permission

  • Sell, rent, lease, or sublicense the App

  • Use the App for commercial purposes without authorization

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Drage Apps, its officers, directors, employees, and affiliates SHALL NOT BE LIABLE FOR:

  • Any health issues, injuries, or damages resulting from sun exposure or use of the App

  • Inaccuracies in UV index data, weather forecasts, or burn time calculations

  • Decisions made based on App recommendations

  • Third-party service interruptions (OpenWeatherMap, Apple CloudKit, RevenueCat)

  • Data loss, corruption, or technical failures

  • Device malfunctions or incompatibility issues

  • Consequential, indirect, incidental, special, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES:

  • We make no warranties about accuracy, reliability, or completeness of UV data

  • We do not guarantee uninterrupted or error-free operation

  • We are not responsible for third-party content or services

Your sole remedy for dissatisfaction with the App is to stop using it and delete it from your device.

Some jurisdictions do not allow limitations on implied warranties or limitation of liability, so these limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Drage Apps and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App

  • Your violation of these Terms

  • Your violation of any rights of third parties

  • Any health issues or injuries related to sun exposure

  • Your breach of any applicable laws or regulations

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy (available in Settings > Privacy Policy) for detailed information about:

  • What data we collect and how we use it

  • How we protect your personal health information

  • Your rights regarding your data

  • Third-party services we use

By using Shade, you consent to our data practices as described in the Privacy Policy.

We comply with applicable privacy laws including GDPR (EU), CCPA (California), and other regional data protection regulations.

10. Third-Party Services

The App integrates with third-party services:

OpenWeatherMap:

  • Provides UV index and weather data

  • Subject to their own terms and privacy policy

  • We are not responsible for their service availability or accuracy

Apple iCloud & CloudKit:

  • Used for data backup and synchronization

  • Subject to Apple's terms and privacy policy

  • Requires iCloud account and may use your iCloud storage quota

RevenueCat:

  • Manages subscription billing and entitlements

  • Processes payments through Apple's App Store

  • Subject to their privacy policy and terms

We are not responsible for the practices, policies, or content of these third-party services.

11. Termination

We reserve the right to:

  • Suspend or terminate your access to the App at any time for violation of these Terms

  • Discontinue or modify the App or any features without notice

  • Remove content that violates these Terms or applicable laws

You may terminate your use of the App at any time by:

  • Deleting the App from your device

  • Cancelling your Shade+ subscription (if applicable)

  • Deleting all your data through Settings > Data Storage

Upon termination:

  • Your right to use the App immediately ceases

  • You should delete the App and all associated data

  • Subscription fees are non-refundable unless required by law

  • Some provisions of these Terms (liability, indemnification) survive termination

12. Changes to Terms

We may update these Terms from time to time. When we make changes:

  • We will update the "Effective Date" at the top

  • We will notify you through the App or by email for material changes

  • The updated Terms will be posted in Settings > Terms of Service

Your continued use of the App after changes constitutes acceptance of the new Terms.

If you do not agree with updated Terms, you must stop using the App and delete it from your device.

It is your responsibility to review the Terms periodically.

13. Governing Law and Disputes

These Terms are governed by the laws of Australia, without regard to conflict of law principles.

Dispute Resolution:

  • Any disputes will first be attempted to be resolved through good-faith negotiations

  • If negotiations fail, disputes may be resolved through binding arbitration or mediation (where permitted by law)

  • Class action rights are preserved in accordance with Australian Consumer Law

Exceptions:

  • Small claims court actions are permitted

  • Claims of intellectual property infringement may be brought in court

Australian Consumer Law:

  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) or other applicable law that cannot be excluded, restricted, or modified by agreement

Jurisdiction:

  • You consent to the non-exclusive jurisdiction of courts in Australia for any legal proceedings

  • Australian residents may also bring claims in their local state or territory courts

14. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Drage Apps regarding the App.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.

App Store Terms: Your use of the App is also subject to Apple's App Store Terms and Conditions.
